ISO 14001 and the Legal Register: What You Need to Know

What is ISO 14001?

ISO 14001 is the international standard for Environmental Management Systems (EMS). It provides a framework for organisations to manage their environmental responsibilities systematically — controlling environmental impact, meeting compliance obligations, and driving continual improvement in environmental performance. Certification signals to customers, regulators and stakeholders that environmental risk is being actively and credibly managed.

Where the legal register sits in ISO 14001

Unlike ISO 9001, ISO 14001 names this requirement explicitly. Clause 6.1.3 (Compliance Obligations) requires organisations to:

• Determine and have access to the legal requirements and other requirements relevant to their environmental aspects
• Determine how these requirements apply to the organisation
• Take these requirements into account when establishing, implementing and maintaining the EMS
• Keep this information up to date

This is almost always evidenced through a register of legal and other requirements — a live record mapping every applicable environmental law, permit condition, and regulatory obligation to your actual operations. Clause 9.1.2 then requires you to periodically evaluate compliance against this register, so it isn’t a one-off document — it needs to be maintained and actively checked.

What does an environmental legal register cover?

For each relevant requirement, a good register typically records:

• The legislation, permit, licence or consent it relates to
• How it applies to your specific sites, processes or emissions
• The controls or actions in place to demonstrate compliance
• Responsible person(s)
• Evidence of compliance and review dates

Environmental legislation is particularly prone to change — new regulations, updated permit conditions, evolving waste and emissions rules — so keeping the register current is often the hardest part for organisations to manage internally.
